In addition to this, you are subject to the policies applicable to membership plans on PracticalHire.com. By accessing and using PracticalHire.com, you agree to be bound to these terms and conditions. Please be aware that if Practical Hire determines at any time that you have abused or violated any of the terms or conditions in this agreement, Practical Hire reserves the right to terminate your access to the Site and Services immediately without notice. If you do not agree to the terms and conditions of this agreement, you must immediately discontinue all usage of this website. Practical Hire reserves the right to modify, alter or update the terms and conditions of this agreement at any time without prior notice. Modifications to this Terms of Use Agreement shall be made effective immediately upon being posted to the website. Your continued use of Practical Hire’s website or Services after such changes are posted will indicate your acknowledgment and agreement to these revised terms. You should visit this page periodically to review this agreement.

1. Basic Terms

As a user of the Site or Services, you agree to use the Site and Services only for lawful purposes. The use of the Site or Services for distribution, transmission, retrieval or storage of any information, data or other material in violation of any applicable law or regulation is prohibited. Furthermore, you agree to make the following commitments to us:

1. You will not use Practical Hire to do anything unlawful, malicious, deceptive or discriminatory.

2. You will not threaten, bully, harass, defame, embarrass or intimidate any person, group or user.

3. You will not use any automated means such as harvesting bots, robots, spiders or scrapers to collect users’ content or information, or otherwise access Practical Hire’s Sites without prior authorization.

5. You will not upload any viruses, worms or any malicious code.

6. You will not post any content that is: unlawful, harmful, defamatory, slanderous, obscene, vulgar, or pornographic; incites violence; contains nudity; graphic or unnecessary violence, or otherwise offensive material.

7. You will not post or send any unsolicited advertising, junk emails, chain letters or unauthorized commercial communications such as spam.

8. You will not post any inaccurate, misleading or fraudulent information.

9. You will not create a false identity or fictitious email address or otherwise attempt to mislead others as to the identity of the sender or the origin of the message.

10. You will not solicit login or account information, nor will you access an account belonging to someone else.

11. You will not resell or make commercial use of the Service without prior written consent from Practical Hire.

12. You will not do anything that could disable or impair the proper operation or appearance of Practical Hire.

2. Description of Service

PracticalHire.com (“Practical Hire”, “we”, or “us”) provides members and visitors with Virtual Assistant Services. The term “virtual” indicates anything that can be handled through the Internet, phone or email. The member is responsible for the following: all equipment necessary for their own Internet connection, access to Internet connection and all fees related to the Internet connection. In addition to this Terms of Use Agreement, all registered members are subject to the policies as stated at http://www.practicalhire.com/service-agreement/.

3. Privacy

Through your use of the Services, you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of provided information to the United States and/or other countries for storage, processing and use by Practical Hire. We recommend that you review our Privacy Policy, which is incorporated for reference in this Terms of Use Agreement, at http://www.practicalhire.com/privacy/.

4. Account, Username & Password

You are entirely responsible for maintaining the confidentiality of your account, username and password, and you are solely responsible for any and all activities that occur under your account, username and password whether authorized or not authorized. You agree to immediately notify Practical Hire of any unauthorized use of your account, or any other breach of security related to the Site. Practical Hire will not be liable for any loss or damage as a result of your failure to adequately protect your account or to otherwise comply with this section.

5. Eligibility

The Services and the Site are only available to individuals or entities who can form legally binding contracts under applicable law, and who are employees, affiliates or representatives of entities that have established a service agreement with Practical Hire or one of its distributors. Individuals under the age of eighteen (18) are not eligible to use our services, and we ask that those under the age of eighteen (18) do not submit any personal information to us. If you are under the age of eighteen (18), you may only use this service in conjunction with parental or guardian consent. If you do not meet these requirements, you may not use the Services or the Site.

6. Modifications, Interruption and Termination of Service

Practical Hire reserves the right to partially or completely modify or terminate the Services and/or access to the Site at any time with or without prior notice to you. Should Practical Hire exercise its right to modify or discontinue the Services and/or access to the Site, Practical Hire will not be liable to any user, member or third party. Practical Hire does not guarantee continuous, uninterrupted or secure access to the Site, as it may be interfered with or adversely affected by a number of circumstances outside of Practical Hire’s control. Practical Hire may also impose limits on features or access to all or particular parts of the Site. Furthermore, the Basic Terms, Copyright and Trademark Policy, Disclaimer of Warranties, Third Party Sites, Limitation of Liability, Indemnification, Applicable Laws and Entire Agreement sections set forth in this Terms of Use shall still survive. Practical Hire may refer violators to civil or criminal authorities for prosecution, and will cooperate with appropriate government officials in connection with its investigations of any suspected civil or criminal violations.

7. Affiliate Program

8. Copyright and Trademark Policy

All content included or available on this site, including content, text, graphics, site design, interface, code and/or software thereof is protected by copyright, trademark and other laws of both the United States and foreign countries, all rights are reserved, or is the property of Practical Hire and/or third parties protected by intellectual property rights. Practical Hire’s material may not be reproduced, copied, modified, distributed, displayed, adapted, published, transmitted, downloaded, or experience any form of data extraction or any other commercial exploitation in any way without prior written consent from an authorized officer of Practical Hire. Furthermore, you agree to never use a robot, spider or other automatic devices or manual processes to monitor or copy Practical Hire’s web pages or content without prior written consent from an authorized officer of Practical Hire. Trademarks appearing on the Site, including those of Practical Hire and/or its Services, its Third Party sites, are the property of Practical Hire and their respective partners/associates. Practical Hire’s trademarks may only be used with prior written consent from an authorized officer of Practical Hire. The design and layout of the Site and all other sites owned, operated, licensed or controlled by Practical Hire are protected as trade dress and may never be copied or imitated. You are strictly prohibited from using the Practical Hire name or any of Practical Hire’s trademarks, logos, domain names, graphics, animation and other distinctive brand features. All other trademarks displayed on PracticalHire.com are the trademarks of their respective owners.

9. Disclaimer of Warranties

Practical Hire provides the site to you on an “as, is, with all faults” basis, and your use of such sites, services, content and materials is at your own risk. Practical Hire disclaims all warranties of any kind, whether expressed or implied, regarding the usage or results of this site in terms of its accuracy, reliability, merchantability, or otherwise, to the fullest extent permitted by applicable law. Furthermore, Practical Hire disclaims all warranties in regards to the information provided, including expressed or implied, without limitation to warranties of merchantability, fitness for particular purpose, title and non-infringement. Furthermore, Practical Hire cannot and does not guarantee or warrant that files available for downloading through the Site are free of viruses, infection worms, Trojan horses or other code that can or would contaminate or destruct properties. PRACTICAL HIRE AND/OR ANY OF ITS PARTNERS, PROVIDERS, AFFILIATES, INCLUDING THEIR RESPECTIVE EMPLOYEES, REPRESENTATIVES OR OFFICERS SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, COMPENSATORY, PUNITIVE, OR DAMAGES RESULTING FROM THE LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA OR LOSS OF USE ARISING FROM OR RELATED TO THIS SITE OR THE INFORMATION CONTAINED IN IT, WHETHER SUCH DAMAGES ARISE IN CONTRACT, NEGLIGENCE, TORT, UNDER STATUTE, IN EQUITY, AT LAW OR OTHERWISE, EVEN IF PRACTICAL HIRE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES; THEREFORE, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH STATES, PRACTICAL HIRE’S LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify, defend and hold harmless Practical Hire, its telecommunications and service providers, its parents, subsidiaries, affiliates, officers, directors, employees, consultants and agents, from any and all claims or demands, liability, damages and costs whatsoever (including but not limited to attorneys’ fees) arising from or relating to your use of Services and/or the Site, any content you post, e-mail, transmit or relay either to Practical Hire or by use of the Services or the Site, your violation of this Terms of Use Agreement, your infringement of any intellectual property or any other right of any person or entity, and/or your violation of any law or regulation.

13. Applicable Laws

Our website is operated and provided in the State of Florida and you thereby agree to submit yourself to the jurisdictional statutes and laws of the State of Florida. As such, the laws of the State of Florida will govern this Terms of Use Agreement or to your use of the Site. Practical Hire makes no representation that the Site or its Services are appropriate, legal or available for use in other locations, and accessing them from territories where its contents are illegal is prohibited. By using the Site, you assume all knowledge of applicable law and you maintain responsibility for compliance with any such law. You may never use the Services in any way that violates applicable state, federal or international laws, regulations or other government requirements. Furthermore, you agree not to transmit any material that encourages behavior that could constitute a criminal offense, give rise to a civil liability or otherwise violate any applicable local, state, national or international law or regulation.

14. Entire Agreement

If any provision(s) of this Terms of Use Agreement is found to be unlawful, void or unenforceable for any reason, the other provisions, and any partially-enforceable provisions, shall not be affected thereby, and shall remain valid and enforceable to the maximum possible extent. This Terms of Use Agreement shall apply in addition to, and shall not be superseded by any other written agreement between us in regards to your use of Practical Hire’s Site and/or Services including all prior or concurrent written or oral understandings and agreements. Any waiver of any provision of the Terms of Use Agreement will only be made effective if unambiguously written and signed by Practical Hire. Any cause of action or claim you may have with respect to the Services or Site must initiate within one (1) year after the cause of action or claim, or such cause of action or claim is barred. Practical Hire’s failure to enforce strict performance of any provision of this Agreement shall not be interpreted as a waiver of any provision or right. Neither the course of conduct between parties, nor trade practice shall act to modify any policy in this Agreement. You understand that by accepting this Terms of Use Agreement, you are consenting to the use and disclosure of your personally identifiable information and other practices described in our Privacy Policy Statement. Any rights not expressly granted are reserved.
